The client was enrolled in the Accelerated Rehabilitative Disposition Program (ARD), a First Offender DUI program, in a neighboring county when he was pulled over by police and cited for Driving While Suspended, DUI Related (75 Pa.C.S. §1543(b)), in Chester County. He was also charged with several other significant traffic violations. These citations caused major complications for him and prompted the District Attorney’s Office to file for his removal from ARD. The client was facing a mandatory minimum sentence of 60 days in jail for driving with his suspended license, along with a $500 fine and a significant additional license suspension. Furthermore, if removed from the first offender program, he would then be facing an additional mandatory jail sentence, fines, license suspension and a lifetime conviction on his record. As the client drove for a living, any loss of his driver’s license would have had a devastating impact on his life.

Through intense negotiations with the Assistant District Attorney, criminal defense attorney Curt Norcini was able to resolve the situation with no jail time, a $200 fine, no license suspension, and the balance of the traffic citations were withdrawn. This resolution helped the client remain in the first offender program in the neighboring county for which he was scheduled to be removed.
