There are three different categories of support payments that may be awarded to a financially dependent spouse. The first is Spousal Support which is money paid to a financially dependent spouse after separation but before a Divorce Complaint is filed in the Court of Common Pleas. The second is Alimony Pendente Lite (commonly referred to as APL). APL is support paid after a Divorce Complaint is filed but before the divorce becomes final. Literally meaning “court-ordered provision for a spouse while the action is pending,” APL may be payable until the Divorce Decree is entered and all financial issues involving equitable distribution are resolved. The final category is Alimony. Alimony consists of payments to the dependent spouse after a Divorce Decree is entered and all financial issues have been resolved. When determining alimony, the court takes into consideration the income of both spouses as well as the assets of each after being divided.

There are also several types of alimony. Rehabilitative Alimony may be awarded to a financially dependent ex-wife or ex-husband when that person is in need of a specific amount of time to “rehabilitate” through education, job training, etc. Reimbursement Alimony may be awarded to an ex-spouse to repay them for expenses incurred for the benefit of the other spouse. Examples are when one spouse has paid for marital debt or when one spouse financially supported the family while the other was attending school. Permanent Alimony can be awarded to be paid to the former spouse for the duration of that former spouse’s life.
